A Câmara dos Deputados aprovou nesta quarta-feira (7), por 315 votos a 143, o pedido que suspende processo contra Ramagem (PL-RJ), réu no inquérito do Supremo Tribunal Federal (STF) sobre um plano de golpe de Estado.

A Comissão de Constituição e Justiça (CCJ) da Câmara dos Deputados aprovou, nesta quarta-feira (7), por 44 votos a 18, um requerimento para suspender o processo penal contra o deputado Alexandre Ramagem (PL-RJ) no Supremo Tribunal Federal (STF). O parlamentar foi denunciado pela Procuradoria-Geral da República (PGR) por envolvimento em uma suposta tentativa de golpe de Estado e virou réu no caso por decisão da Primeira Turma da Corte em 26 de março.

“Fica sustado o andamento da ação penal contida na petição. Essa resolução entra em vigor na data da sua promulgação”, disse o presidente da Câmara logo após a votação. “Determino o encaminhamento dessa resolução ao STF junto com as notas taquigráficas desta sessão”, complementou.

Mais cedo, a Comissão de Constituição e Justiça (CCJ) da Casa aprovou o relatório do deputado Alfredo Gaspar (União-AL) que pede a suspensão integral da ação. Além disso, Gaspar também propôs um projeto de resolução que abre brecha para travar toda a ação no Supremo, beneficiando outros réus.

A votação no plenário ocorreu sem que houvesse discussão entre os deputados. Também não houve espaço para apresentação de emendas (sugestões de mudanças no texto).

A decisão da CCJ não é definitiva. O texto precisa passar pelo crivo do plenário da Câmara, com o apoio de 257 deputados. O PL trabalha com essa ação de modo a não apenas paralisar o processo contra Ramagem

caso contra Ramagem, mas também contra o ex-presidente Jair Bolsonaro (PL), réu na mesma ação penal por tentativa de golpe.

No dia em que o documento foi enviado à Mesa Diretora, em abril, o líder do partido na Casa, Sóstenes Cavalcante (PL-RJ), afirmou que uma eventual suspensão do processo beneficiaria todos os réus da ação penal. “Essa foi a melhor notícia do dia para a defesa do presidente Bolsonaro”, disse.

O PL alega que todos os supostos crimes imputados a Ramagem foram cometidos após a diplomação dele em 19 de dezembro de 2022 O partido usou como exemplo os atos golpistas de 8 de Janeiro. “Porquanto o crime de organização criminosa armada, que possui natureza permanente, teria se estendido até janeiro de 2023, e os demais crimes imputados teriam ocorrido no dia 8 de janeiro de 2023”, justificou.

A sigla fundamenta a ação num trecho da Constituição – artigo 53, parágrafo 3º – que dá para a Câmara o poder de interromper o andamento de uma ação penal enquanto o parlamentar mantiver o seu mandato. Na sessão desta quarta-feira, Ramagem afirmou que as acusações contra ele são baseadas em uma “narrativa de fatos”. O parlamentar repetiu a tese de defesa de seus advogados de que não há “razoabilidade” na denúncia porque ele havia acabado de ser eleito deputado federal.

“Todos sabem que a espinha dorsal dessa ação penal se trata da colaboração premiada do tenente-coronel Mauro Cid. Quantas menções na delação do Mauro Cid foram feitas em meu nome? Zero. Nenhuma. Mauro Cid não mencionou meu nome uma única vez. Se como eu falei, toda a narrativa de atos, fatos, reuniões, planos está ali, eu pergunto a vocês, como é que eu faço parte do núcleo crucial de uma tentativa de golpe, dessa ação de golpe, se não há nenhuma conduta minha?”, questionou Ramagem durante reunião da comissão.

E acrescentou: “Como eu poderia estar fazendo tratativa de golpe se eu estava focado no Rio de Janeiro tratando de uma campanha eleitoral dificílima em qualquer Estado da federação?”. A base do presidente Luiz Inácio Lula da Silva chegou a apresentar um pedido de adiamento da votação sob o argumento de que o relatório “extrapola” os limites da Constituição ao resolver sustar “o andamento da Ação Penal contida na Petição n. 12.100, em curso no Supremo Tribunal Federal, em relação a todos os crimes imputados”, o que, em tese, se estenderia a todos os réus pela tentativa de golpe de Estado. A decisão beneficiaria o presidente Jair Bolsonaro.

O deputado Rubens Pereira Junior (PT-MA) argumentou que o artigo 53 é restrito à possibilidade de sustação da ação penal de deputados e senadores. “O extrapolamento, onde se passa do ponto, é quando diz que a decisão do Poder Legislativo susta a ação em relação ao parlamentar e aos demais corréus. Isso não tem amparo na Constituição. O artigo 53, parágrafo 3.º, elencado traz no início ‘recebida a denúncia deputado e senador’”, afirmou.

A tese foi defendida também pelo deputado Lindbergh Farias (PT-RJ). De acordo com o parlamentar, a decisão de suspender a ação é inconstitucional. “Os senhores acham que o Supremo está preocupado? É claro que não.”

“Estamos tendo a ousadia de propor a ação penal do Bolsonaro. Eu entendo o pessoal do PL, eu entendo a turma que é bolsonarista. Eles não querem que esse julgamento aconteça. Estavam defendendo aqui aquela anistia, que é inconstitucional, que é absurda, porque nós estamos prestes a começar a um julgamento. Mas confesso meu espanto com a possibilidade de voto de deputados dos partidos de centro. Votar numa barbaridade como essa…”, afirmou.

Em reação à representação do PL, o ministro Cristiano Zanin, do Supremo, enviou, em abril, um ofício à Câmara para informar que a ação na Primeira Turma que tornou Ramagem réu não pode ser sustada em sua integralidade.

Suspensão das acusações

O pedido de suspensão da ação penal foi apresentado pelo PL e tem como base o 53º artigo da Constituição. A norma define que todos os deputados e senadores são invioláveis, civil e penalmente, “por quaisquer de suas opiniões, palavras e votos”.

A Constituição prevê que o pedido seja analisado pelo plenário da Casa no prazo de 45 dias. Se o recurso for aprovado por ao menos 257 deputados, a ação penal fica suspensa enquanto o réu tiver mandato. Se o deputado não for reeleito ou perder o mandato, o processo volta a correr normalmente.

Apesar da decisão da CCJ, o STF decidiu que a Câmara não pode anular integralmente o processo contra Ramagem. A decisão da Casa só poderá atingir duas das cinco acusações contra o parlamentar, as que investigam crimes que teriam ocorrido após a diplomação – como estabelece a Constituição para a suspensão da ação penal.
